GOVERNING LAW

We run a business in Japan, and we are sending information from Japan. Law is based on the Japanese law. Osaka District Court shall have exclusive jurisdiction for the first instance. The commercial law is in compliance with the Japanese law.


LIMITATION OF LIABILITY

OYATSU Cha Cha Cha and its staff shall not be liable for any unauthorized access to our servers or stored personal / financial information. In no event shall we be liable to you for any direct, indirect, incidental, special, punitive or consequential damages resulting from any mistakes in the website, services, content including user created content, or for injury or property damage of any nature whatsoever resulting from the use of the website, apps or services. We make no guarantees for the availability or reliability of the website, apps or services, for the safety of use or the suitability of the services to your purpose. Our responsibility shall be limited to the fullest extent permitted by law.

If there is your country in the List of Countries with SAL(Japan Post Economy Air), you can join this subscription.

OUR SUBSCRIPTION SERVICE

After you subscribe the service that we offer, monthly boxes are shipped to your address at the price listed. You acknowledge that the monthly subscription will have an initial and recurring payment feature. The last day of every month is the deadline to subscribe.In one example, if you subscribe between January 1st and January 31st, you can get January's subscription.

THE CURRENCY FOR PAYMENT

The prices will be displayed in US dollar. The currency for payment is US dollar.

SECURE METHOD OF PAYMENT

For payments we trust PayPal which is the most popular online payment service. PayPal helps protect your credit card information with the best system on the market for security and prevent against fraud. When you use PayPal, your financial information is never shared with OYATSU Cha Cha Cha. Of course we accept credit cards.

SCHEDULE OF PAYMENT

The day when you order is the first date of payment. Future payments will be charged 30 days after initial payment. The monthly schedule of payment occurs on the same date of every month. In one example, if you order on January 13th, you will be charged on January 13th and the 13th of every following month.

CANCEL

The last day of every month is the deadline to subscribe. You can cancel the subscription after this  month if before a deadline to subscribe. When you cancel it after deadline, the subscription is effective. How to cancel is different by your payment method and the timing of your cancellation. If you paid by PayPal, you can cancel your subscription online. If you canceled your subscription after date of payment, please give us an email. We refund you expenses.

 

In the case where you paid by credit card, please give us an email. We cancel your subscription and refund you expenses.

In one example, January 31th is the deadline of the January's subscription. If you cancel on January 31th, the January's subscription (shipping date is February 7th) will be canceled. If you cancel on February1st, the January's subscription (shipping date is February 7th) will be shipped. But February's subscription (shipping date is March 7th) will be canceled.

 

After your parcel depart, in the case where you want to cancel the subscription, we can't stop delivery. Firstly, please contact us by an email. Next, when the parcel is delivered to your home, please refuse to receive it. Then the parcel is sent back to Japan. When we receive it back in the office and it is unopened, we will proceed to issue you a full refund. It may take several weeks.

POSTAGE

The postage is included in sales price.

CUSTOM DUTY

Customs duty is the customer’s responsibility as the customer is the importer of such items. No customs duties nor customs handling services of any kind are included in the price of product. 


DELIVERY OF THE PRODUCT

SHIPPING METHOD

For transportation we use SAL(Japan Post Economy Air). Please check if this service is available in your country. When a parcel crosses borders, they may be subject to customs charges determined by customs officials. 

SHIPPING DATE

We send out your box every month on 7th. It arrives in about two weeks. Please check delivery days in SAL page. In one example, If you order the subscription on January 13th, we will ship your box on February 7th, and we will ship it on the 7th of every following month.

PRODUCTS DAMAGED OR LOST DURING TRANSPORTATION

A parcel has tracking service and insurance. If a part of the assortment is lost or damaged, please save it as the present conditions. It is necessary for you to report a lack and a damage to the local post office. Please give us an email. After we confirm the situation and we receive the damage goods back in the office, we resend goods or we refund you expenses. It may take several weeks. The cost of return and re-shipment is at our expense. If an assortment would not arrive after four weeks from a shipment day, please give us an email. After we confirm the situation and we understand it's a trouble of the delivery, we resend goods. The cost of return and re-shipment is at our expense.

PARCELS RETURNED BY POST

When a package is returned by mail, in cases where OYATSU Cha Cha Cha is wrong, we will re-ship the package without charge. In cases where OYATSU Cha Cha Cha is not wrong re-shipment will be at the expense of the recipient.

All items sold on OYATSU Cha Cha Cha are original articles purchased and shipped from Japan. All products are intended for the Japanese market and comply with standards and legislation in force in Japan. In most cases the information and usage tips included in the packaging is in Japanese only.

ALLERGIES

OYATSU Cha Cha Cha and its staff have no liability on injury or damage caused by products within the box. You agree not to subscribe to any subscriptions which contain edible products if you have allergies. If you do so, Please consume the goods at your own risk.

ORIGINAL DEFECTIVE PRODUCTS

We pay attention to handling the products as much as possible. However, if you receive a defective product please send us pictures showing the problem. After we confirm the problem and we receive the defective products back in the office, we resend products or we refund you expenses. It may take several weeks. The cost of return and re-shipment is at our expense.

RETURNED GOODS

If the box is unopened and the goods are new condition, returning goods is possible for less than one week after the arrival of the box. Please give us an email first. You pay the postage. When one week passses, you cannot return goods even if unopened. When we receive it back in the office, we will proceed to issue you a full refund.
